Alex and Brittany are a young 25-year-old couple. They have been married for 3 years and live
in a house they just purchased in Miami Beach, FL. Alex is a cook at a restaurant named “The
Burger Joint” and Brittany is a teller at Wells Fargo Bank. Alex has worked at the “The Burger
Joint” for 5 years and is the head cook at the restaurant. On May 20, 2018 “The Burger Joint”
hired a new cook to help Alex cook at “The Burger Joint” as the restaurant is becoming very
popular and Alex needs help fulfilling orders. The owner of the restaurant hires Carlos, a former
Mixed Martial Arts professional fighter who has recently taken up cooking as a career after
breaking his pinky finger in an MMA fight which forced him to retire. Had it not been for the
broken pinky there is no doubt that Carlos would have been the heavy weight mixed martial arts
champion of the world as he is 6’8” tall and weighs 275lb. His skills are exceptional and
continues to train in MMA every day.
Alex and Carlos have become acquainted working together at the restaurant’s kitchen and begin
to hang out after work doing such things as drinking beer and play pool at bars in Miami Beach.
Alex is an avid MMA enthusiast and had actually seen Carlos fighting in Las Vegas on pay-perview before his injury. Alex always tells Carlos that he would be scarred to fight Carlos because
of his size and skills. Alex is 5’4” tall, weighs 130 lbs., and doesn’t even know how to punch.
Due to this Alex always, carries a gun with him.
On November 28, 2018 after work at 2:00 p.m. Alex invites Carlos to his home in Miami Beach.
Alex and Carlos begin to watch television and drink beer until about 5:00 p.m. At that point they
run out of beer and Alex tells Carlos he is going to walk to the gas station down the street to buy
more beer. Carlos then stays in Alex’s home by himself while Alex goes to the gas station.
At about 5:05 p.m. Brittany gets home and sees Carlos sitting on the couch. Brittany has never
met Carlos and asks where Alex is. Carlos says that Alex went to the gas station and introduces
himself. Brittany informs Carlos that she has heard a lot about him from Alex and has also seen
Carlos on television on the past fighting in Las Vegas. Brittany then goes to the back of the
kitchen pantry and tells Carlos there was actually beer in the house. She opens a beer for herself
and gives one to Carlos. They then sit on the couch and start talking and drinking. As they are
doing this Brittany kisses Carlos in the mouth. At that exact moment at approximately 5:50 p.m.
Alex comes back from the gas station with the beer. He opens the door and sees Brittany and
Carlos kissing. Alex is shocked at what he is seeing. He is both heart broken and upset all at
once. Carlos and Brittany see Alex and are also shocked. Carlos immediately stops kissing
Brittany and gets up from the couch. Carlos then walks quickly towards the door where Alex is
standing. As Carlos approaches the door where Alex is standing Alex shoots Carlos in the head
and kills him.
Alex is arrested for first degree murder.
